OUR COMMITMENT

Poder Latinx values the trust of every donor and supporter. This Donor Privacy Policy describes the information we collect when you contribute to Poder Latinx, how we use that information, the limited circumstances in which we share it, and the choices available to you. This policy applies to Poder Latinx a 501(c)(4) organization). It does not govern the practices of independent third-party platforms even when those platforms are linked from our materials.

INFORMATION WE COLLECT

When you make a contribution or otherwise interact with Poder Latinx, we may collect:Identifying information you provide, including your name, postal address, email address, phone number, and employer or occupation where required by law.Payment information processed by our payment processors. Poder Latinx does not store full credit or debit card numbers on our systems.Contribution information, including the amount, date, and designation of your gift, and any campaign or appeal you responded to.Communications you send us, and information about how you engage with our emails, website, and digital ads.

HOW WE USE YOUR INFORMATION
We use donor information to:Process your contribution and send you a contribution acknowledgment.Comply with federal, state, and local reporting and recordkeeping obligations applicable to 501(c)(4) organizations.Communicate with you about Poder Latinx’s future opportunities to support that work.Steward the donor relationship, including thanking you, updating you on impact, and inviting you to events and programs.Conduct internal analysis to improve our programs, communications, and fundraising practices.

HOW WE SHARE YOUR INFORMATION
Poder Latinx does not sell or rent donor information. We share donor information only in the following limited circumstances:Service providers: with vendors and contractors who perform services on our behalf (for example, payment processing, email delivery, CRM hosting, mailing services), and only to the extent reasonably necessary for those services. These vendors are contractually required to protect donor information.Affiliated entities: with Poder Latinx’s affiliated 501(c)(3) and political action committee, where permitted by law and where doing so is consistent with this policy.Legal compliance: where disclosure is required by law, including reporting required under federal tax, election, or campaign-finance law, or in response to a valid legal process.Aggregated or de-identified data: we may share aggregated or de-identified information that cannot reasonably be used to identify any individual donor.
We do not exchange, rent, or sell donor lists with other organizations for fundraising or commercial purposes.


ANONYMOUS GIFTS

You may request that your contribution be treated as anonymous in any public donor recognition or listing. Anonymity in public recognition does not exempt the contribution from any reporting that may be required by law.

ONLINE AND DIGITAL PRACTICES

Our website uses cookies, pixels, and similar technologies for site functionality, analytics, and advertising. You can control these technologies through your browser settings and through any consent controls offered on our site. We use third-party analytics and advertising services, and these services may collect information about your interactions with our website subject to their own privacy policies.

DATA RETENTION

We retain donor information for as long as necessary to fulfill the purposes described in this policy and to meet our legal, tax, accounting, and recordkeeping obligations. Records required for tax and campaign-finance purposes are retained for the periods required by applicable law.

SECURITY

Poder Latinx implements administrative, technical, and physical safeguards designed to protect donor information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is fully secure, and we cannot guarantee absolute security.

YOUR CHOICES

You may, at any time:Request that we update or correct your contact information.Opt out of email or postal solicitations from Poder Latinx.Request that your name be omitted from any public donor recognition.Request access to or deletion of your personal information, subject to any legal obligation to retain certain records.

STATE SPECIFIC PRIVACY RIGHTS
Residents of certain states have additional rights regarding their personal information. If you are a resident of a state with applicable consumer privacy law (for example, California, Colorado, Connecticut, Texas, Virginia, or Utah), you may have the right to know what personal information we collect, to request access or deletion, and to opt out of certain processing. To exercise these rights, contact us at the address below. We will not discriminate against you for exercising any privacy right.

CHILDREN
Poder Latinx does not knowingly solicit contributions from individuals under the age of 18. If you believe we have inadvertently received information from a minor, please contact us so we can delete it.

CHANGES TO THIS POLICY
We may update this Donor Privacy Policy from time to time. The “Last updated” date at the top of this policy reflects the most recent revision. Material changes will be highlighted on our website.
